Terms
These Terms & Conditions govern purchases from and use of the Will of Water online store. We have written them to make the commercial relationship as clear as possible while preserving all rights that cannot legally be excluded.
1. Seller information

2. Scope
These terms apply to orders placed through our online store and to use of the store. Additional or product-specific conditions may apply where clearly disclosed before purchase. Mandatory consumer-protection rights applicable in the customer's country are not excluded by these terms.
3. Product information
We aim to describe and present products accurately. Images, colours and packaging may vary slightly depending on screens, production changes and supplier updates. Product availability can change without notice.
Information on our website concerning water, wellbeing, lifestyle or product performance is provided for general informational purposes and should not be interpreted as medical advice. Unless expressly stated and legally authorised, our products are not presented as diagnosing, treating, curing or preventing disease.
4. Ordering and formation of contract
Product listings are an invitation to place an order rather than a guarantee that we will accept every order. By completing checkout, you submit an offer to purchase the selected products. A contract is formed when we accept the order, for example by sending an order acceptance or shipping confirmation, depending on the checkout process and applicable law.
We may decline or cancel an order before acceptance where there is a pricing or technical error, suspected fraud, unavailable stock, an inability to deliver to the stated destination, or another legitimate reason. If payment has already been collected for an order we cannot fulfil, the relevant amount will be refunded.
5. Prices, taxes and payment
Prices are displayed in the currency shown in the store. Applicable taxes, shipping charges and other amounts that we collect will be displayed during checkout where required. For cross-border deliveries, import VAT, customs duties or carrier handling fees may be payable separately unless expressly included.
Payment must be made using the payment methods offered at checkout. Payment services may be provided by Shopify or third-party payment providers and may be subject to their own terms and privacy practices.
6. Delivery
Available delivery methods, costs and estimates are shown during checkout or otherwise communicated before purchase where required. Delivery estimates are not guaranteed unless expressly agreed as such. Our Shipping & Returns page forms part of these terms and contains further information about fulfilment, delivery, customs, returns and refunds.
7. Consumer withdrawal and returns
For customers in Switzerland, there is generally no automatic statutory cooling-off right for ordinary online purchases; however, we offer the voluntary return arrangement described in our Shipping & Returns policy.
Where mandatory EU/EEA distance-selling law applies, consumers generally have a 14-day statutory right of withdrawal, subject to statutory exceptions. The procedure, model withdrawal form, return conditions and refund information are set out in our Shipping & Returns policy. Nothing in these terms limits a mandatory withdrawal right.
8. Defects and statutory guarantees
We aim to supply products that conform to the contract and applicable law. If a product is defective or non-conforming, please contact us promptly with your order details and a description of the issue. Rights and remedies for defects, conformity and guarantees are governed by applicable mandatory law and may differ between Switzerland and EU/EEA jurisdictions. These terms do not exclude or reduce statutory consumer rights that cannot legally be waived.
9. Use and installation
Products must be used, maintained and, where applicable, installed in accordance with supplied instructions, technical requirements and reasonable safety practices. Where professional installation is required or recommended, customers are responsible for ensuring that installation is carried out by a suitably qualified person unless installation is included in the purchase contract.
10. Website use
You may use our website for lawful personal and commercial purchasing purposes. You must not misuse the website, interfere with its security or operation, attempt unauthorised access, introduce malicious code, use automated systems in a way that imposes an unreasonable burden, or use our content in violation of intellectual-property rights.
11. Intellectual property
Website content and Will of Water brand materials are protected by intellectual-property laws. Our Copyright page provides additional information and forms part of these terms. Third-party trademarks and materials remain the property of their respective owners.
12. Third-party services and links
Our store may integrate with or link to third-party services, including Shopify, payment providers, carriers and external websites. We are not responsible for independent third-party websites or services outside our reasonable control. Their own terms and privacy policies may apply.
13. Liability
To the maximum extent permitted by applicable law, we are liable in accordance with the ordinary rules of applicable law, but we exclude liability that may lawfully be excluded for indirect or consequential losses not reasonably foreseeable at the time of contracting. Nothing in these terms excludes or limits liability where exclusion or limitation is prohibited, including mandatory liability for intentional or grossly negligent conduct, personal injury where applicable, product liability, or mandatory consumer rights.
14. Force majeure and events beyond reasonable control
We are not responsible for delay or failure caused by events beyond our reasonable control, such as severe transport disruption, natural events, governmental action, major infrastructure or network failure, labour disruption, or comparable events, except to the extent mandatory law provides otherwise. We will take reasonable steps to reduce the impact where possible.
15. Personal data
Our processing of personal data is described in our Privacy Policy. By using the store, you acknowledge that personal data necessary to operate the store, process orders, prevent fraud and meet legal obligations will be processed in accordance with applicable data-protection law.
16. Governing law and disputes
These terms are governed by substantive Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods, to the extent such exclusions are legally effective.
For consumers, this choice of law does not deprive you of mandatory consumer protections that apply under the law of your habitual residence where such protections cannot legally be waived. Any mandatory rules concerning competent courts and consumer jurisdiction remain unaffected.
17. Severability
If a provision of these terms is found invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law. The invalid provision will be interpreted or replaced only to the extent necessary to reflect the lawful commercial purpose.
18. Changes
We may update these terms for future use of the store and future purchases. The version applicable to an order is generally the version made available when that order was placed, subject to mandatory law.
